Vigilant Onsite Inc Limited Warranty

This Limited Warranty ("Warranty") is provided by Vigilant Onsite Inc ("Vigilant Onsite" or "we" or "us") to the original purchaser ("Purchaser" or “customer” or "you") of the consumer electronics product ("AKG" or “Product”) covered by this Warranty.

1. Warranty Coverage

Vigilant Onsite warrants that the Product, under normal use and service, will be free from defects in material and workmanship for a period of one year from the date of original purchase ("Warranty Period"). This Warranty is applicable only to the original Purchaser and is not transferable.

2. What is Covered

This Warranty covers defects in materials and workmanship of the AKG device only. We will, at our option, repair or replace any defective Product or part with a new or refurbished Product or part. Any replaced Product or part becomes the property of Vigilant Onsite.  

Inoperable Product operation due to missing or poor cellular service is limited to 45 days from original Product purchase. (see Cellular Coverage Warranty Exception in Appendix A below).

The Warranty Returns Procedure is described in Appendix A below.

3. What is Not Covered

This Warranty does not cover:

a. Damage caused by misuse, abuse, accidents, or negligence.

b. Damage caused by removal of the security label on the device, opening the device, unauthorized modifications or repairs.

c. Damage caused by use with accessories, components, or software not supplied or authorized by Vigilant Onsite.

d. Damage or losses of any facility, asset or property resulting from failure of the Product.

e. Normal wear and tear.

4. How to Obtain Warranty Service

The Warranty Returns Procedure is described in Appendix A below.


5. Limitation of Liability

TO THE EXTENT PERMITTED BY LAW, VIGILANT ONSITE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, INJURY OR FOR ANY DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE USE OR PERFORMANCE OF THE PRODUCT. IN ANY EVENT, DAMAGES ARE EXPRESSLY LIMITED IN VALUE TO A MAXIMUM AMOUNT RECEIVED BY VIGILANT ONSITE FOR THE ORIGINAL PRODUCT PURCHASED BY THE PURCHASER.

6. Warranty Dispute Resolution

Any dispute arising under or in connection with this Warranty shall be resolved through negotiation, and if not resolved, through arbitration in accordance with the rules of the American Arbitration Association, and judgment upon the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof.

7. Governing Law

This Warranty shall be governed by and construed in accordance with the laws of Montana.

8. Consumer Rights

This Warranty gives you specific legal rights, and you may also have other rights that vary from state to state or country to country.

Appendix A: WARRANTY RETURNS PROCEDURE

Vigilant Onsite strives to provide the absolute best in class products and services in everything it sells. Any discovered Product defect should be brought to Vigilant Onsite’s attention as soon as possible. All warranty service must be provided by Vigilant Onsite directly. Product resellers are not authorized to service Product Warranty claims.

In the event that a customer finds it necessary to return a Product to Vigilant Onsite that is covered by our warranty, a process has been established that will ensure proper tracking of the returned Product, and that appropriate credit issues are made. Tracking of returns is accomplished through the issuance of an RMA (Return Material Authorization) number to the customer requesting a return. All Products that are returned to Vigilant Onsite must have an RMA number associated with them to assure proper defect analysis tracking and to ensure that a credit is issued to the appropriate account. Products that are returned without an RMA number will be returned to the customer at the customer’s expense without any further action being taken. The process for returns is as follows:

1. The customer must contact our customer service department by sending email to support@vigilantonsite.com within the Warranty Period. The email must contain contact information for the Customer, proof of purchase (to include date of purchase, seller, and receipt of purchase), serial number of the defective Product (QR code string on the Product) and a description of the problem.  

2. Vigilant Onsite will respond via email seeking additional information, scheduling a call or supplying a Return Material Authorization (RMA) number with directions for device return.  For authorized returns, Purchasers are responsible for return shipping costs. This process ensures that when the package arrives, it is associated with the description provided by the customer and customer account.

3. Vigilant Onsite will evaluate all RMA returned Product, an if found defective will repair or replace, at Vigilant Onsite’s sole option, and return ship the Product to Purchaser and also credit the customer’s account a flat $10 USD. The evaluation and remedy process may take up to 30 calendar days to complete. Any replaced Product or part becomes the property of Vigilant Onsite.

Cellular Coverage Warranty Exception:

Customers that discover the Product is inoperable or provides poor service due specifically to missing or poor cellular coverage may return the Product for full refund of the original Purchase Price if the Product was purchased directly from Vigilant Onsite.  If the Product was purchased from a reseller, the return must be serviced by the reseller directly.

Customers must follow the RMA procedure provided above.  Vigilant Onsite will validate missing or poor cellular performance prior to issuing the RMA.  Only missing or poor cellular performance will qualify Customers for this Warranty Exception.

Cellular Coverage Warranty Exception period is 45 calendar days from original date of Product Purchase.  Warranty claims outside this period are void.
